So it is a bug in MFC, and with my Compiler patched with the latest updates
I'll still get the error.
Are they waiting for VS 2010 to fix this, or is there a workaround for VS
2008 other than compiling the code to use the MFC9 dll.

The bug is minor enough that it doesn't justify the expense and risk of publishing a fixed version for MFC 9. It is fixed in VS2010.
The workaround is to put CSplitterWnd as the base class:
IMPLEMENT_DYNCREATE(CMySplitterWnd, CSplitterWnd)
I don't mean to actually change the CMySplitterWnd definition, just "lie" to IMPLEMENT_DYNCREATE and skip over CSplitterWndEx.
Everything (except one feature) will work as normal: you won't be able to use the IsKindOf (IsDerivedFrom) feature to know that
CMySplitterWnd is really derived from CSplitterWndEx. Does that pose a problem? I'm guessing not.
